Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Futurove, LLC ("TryOdi", "tryodi", "Company", "we", "us", or "our") governing access to and use of TryOdi.
By accessing or using TryOdi, including the web app, AI writing and image generation, brand profile tools, website analysis, social account connection, scheduling, publishing, billing, and related functionality (collectively, the "Services"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility, Age, and Accounts
- You must be at least 13 years old to use the Services.
- If you are under the age of majority in your jurisdiction, you may use the Services only with permission and supervision from a parent or legal guardian.
- To purchase a paid plan, start a card-based trial, or use paid add-ons, you must be at least 18 years old or have legally valid consent.
- You must provide accurate, current, and complete registration information.
- You are responsible for safeguarding account credentials and for all activity under your account.
- You must promptly notify us of unauthorized account use at info@tryodi.com.
2. Service Scope and Nature
TryOdi helps users create, adapt, schedule, and publish social media content. The Services are provided for personal use and internal commercial business use.
The Services are AI-assisted. Outputs may be inaccurate, incomplete, duplicated, outdated, or unsuitable for your brand, audience, platform, legal obligations, or use case. You are responsible for reviewing and approving content before it is published or used.
The Services are not legal, medical, financial, tax, advertising compliance, or other professional advice.
3. License and Access Rights
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services.
You may not:
- Copy, sell, lease, resell, or commercially repackage the Services.
- Reverse engineer, decompile, disassemble, or attempt to derive source code or non-public service components.
- Scrape, harvest, or extract Service data except as expressly allowed by the interface.
- Use the Services or outputs to train or improve competing AI systems without our written permission.
- Interfere with security, abuse prevention, usage limits, billing enforcement, or service integrity.
4. User Content, Inputs, and AI Outputs
You retain your rights in content, files, prompts, briefs, brand information, uploaded media, and other data you submit to the Services ("Input").
You grant us a worldwide, non-exclusive, royalty-free, sublicensable limited license to host, process, transmit, format, store, secure, debug, and otherwise use Input as needed to provide, maintain, improve, secure, and legally operate the Services.
AI-generated captions, ideas, brand summaries, images, and other results ("Output") are probabilistic. Similar or identical output may be generated for other users. To the extent permitted by law and subject to third-party provider terms, you may use Output for lawful personal and internal commercial business purposes.
You are solely responsible for validating Input and Output, securing any required rights, and ensuring that published content complies with platform rules, advertising rules, intellectual property laws, privacy laws, and other applicable requirements.
5. Social Accounts and Publishing
TryOdi may connect to third-party social platforms through a publishing provider. You authorize us and our provider to access connected account metadata and publish, schedule, retry, cancel, or reconcile posts according to your actions in the Services.
Social platforms and publishing providers are third-party services. They may change APIs, review requirements, platform rules, rate limits, account access, and publishing behavior. We are not responsible for third-party outages, restrictions, rejections, account actions, or policy changes.
6. Prohibited Uses
You may not use the Services to:
- Violate laws, sanctions, regulations, platform rules, or third-party rights.
- Create, distribute, or request illegal, deceptive, infringing, harassing, hateful, violent, exploitative, or abusive content.
- Impersonate people or organizations, mislead users, or run fraudulent activity.
- Collect, expose, or publish personal data without authorization.
- Distribute spam, malware, phishing, scams, or network abuse.
- Create automated, bulk, fake, or abusive accounts.
- Bypass usage limits, billing requirements, access controls, or safety controls.
- Use AI output as human-reviewed expert advice without appropriate review.
We may suspend or terminate accounts for violations without prior notice.
7. Pricing, Trial, Billing, Cancellation, and Refunds
Paid plan pricing, currency, billing interval, plan scope, and add-ons are shown at checkout or in the billing interface.
TryOdi may offer a 5-day free trial for self-serve plans. A payment card is required at signup or checkout. No plan fee is charged at trial start unless explicitly stated at checkout. Unless you cancel before the trial ends, the subscription automatically converts to a paid subscription and the selected plan fee is charged.
Subscriptions renew automatically unless canceled before renewal. Cancellation takes effect at the end of the current billing period or trial period, as applicable. Except where required by law, payments are final and non-refundable, and we do not provide prorated credits or refunds for partial periods.
We may suspend or terminate access for failed payment, chargebacks, suspected fraud, abuse, or payment policy violations.
8. Third-Party Services
The Services rely on third-party providers for AI, website analysis, hosting, database, storage, social publishing, payments, authentication, analytics, and email. Third-party services are governed by their own terms and policies.
To the fullest extent permitted by law, we are not liable for third-party outages, delays, data handling, policy changes, API changes, or discontinuation.
9. Intellectual Property
The Services, including software, interfaces, workflows, design, branding, and related intellectual property, are owned by the Company or its licensors. No ownership rights are transferred except for the limited license expressly granted in these Terms.
If you provide feedback, suggestions, or ideas, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation.
10. Privacy
Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Changes to Terms
We may update these Terms from time to time. For material changes, we may provide notice through the Services, by email, or by posting an updated version. Continued use after updates means you accept the revised Terms.
12. Suspension and Termination
We may suspend or terminate access for Terms violations, unlawful conduct, abuse, security risk, payment failure, suspected fraud, or operational risk.
Upon termination, your right to use the Services ends immediately. Provisions that by nature should survive termination remain in effect, including payment obligations, disclaimers, limitation of liability, indemnification, arbitration, and governing law.
13. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, OR OTHER WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, ERROR-FREE OPERATION, AND FITNESS OF AI OUTPUT FOR ANY PARTICULAR USE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, ACCOUNT ACTIONS, PLATFORM REJECTIONS, OR CONTENT PERFORMANCE.
- OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE TERMS OR SERVICES WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
- IF YOU PAID NOTHING IN THE PRECEDING 12 MONTHS, OUR AGGREGATE LIABILITY IS 0 USD.
Some jurisdictions do not allow certain limitations, so parts of this section may apply only to the extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from or related to:
- Your use of the Services.
- Your Input, Output, social posts, uploaded media, and published content.
- Your connected social accounts and platform activity.
- Your breach of these Terms or applicable law.
- Your infringement or violation of third-party rights.
16. Mandatory Individual Arbitration, Class Action Waiver, and Jury Waiver
THIS SECTION AFFECTS IMPORTANT LEGAL RIGHTS.
Any dispute, claim, or controversy arising from or relating to these Terms or the Services must be resolved by final and binding individual arbitration, except claims for injunctive or equitable relief relating to intellectual property.
Arbitration will be administered by the American Arbitration Association (AAA) under applicable AAA rules, except as modified by these Terms. The arbitration seat is Delaware, USA, unless the parties agree to remote proceedings.
Before starting arbitration, each party must attempt good-faith informal resolution for at least 30 days by sending written notice to info@tryodi.com.
ALL DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. CLASS ACTIONS, CLASS ARBITRATIONS, REPRESENTATIVE ACTIONS, AND PRIVATE ATTORNEY GENERAL ACTIONS ARE WAIVED. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law principles. For disputes not subject to arbitration, exclusive venue and jurisdiction lie in the state and federal courts located in Delaware. Unless prohibited by law, any claim must be brought within 1 year after it arises.
18. Force Majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, war, civil unrest, government action, labor disputes, infrastructure failures, internet or telecom outages, and third-party service disruptions.
19. Miscellaneous
These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Services. If any provision is held invalid or unenforceable, the remainder remains in full force. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them.
